1. Gift Card may be used vide Otter Barista’s web application.
2. You may purchase and send virtual Otter Gift Card to anyone via email or mobile number.
3. You are able to personalize Otter Gift Card with a message, choose a design and dollar value (with certain limits).
4. Otter Barista does not charge any fees for the issuance and use of Otter Gift Card.
2. Purchase
1. You can complete your purchase using a credit card, debit card, e-wallet or certain other electronic payment methods and you authorise Otter Barista to charge your choice of payment method at the time of your purchase Otter Gift Card.
2. Upon your successful payment, the electronic Otter Gift Card will be delivered to the recipient on the same day.
3. Otter Gift Card is a pre-payment only for the goods and services of Otter Barista vide Otter Barista’s web application. Therefore, Otter Gift Card is not a credit line, overdraft facility or deposit account and the monetary value associated with Otter Gift Card does not earn interest, dividends or any other earnings nor is there any statutory protection relating to it. The value associated with Otter Gift Card is not insured or guaranteed by any person or entity.
3. Redemption
1. The recipient must redeem Otter Gift Card within one (1) year from the date of purchase.
2. The use of Otter Gift Card will be subject to Otter Barista’s Terms of Use including the location of the recipient where delivery may or may not be available.
3. Otter Gift Card and its unused balance cannot be exchanged for cash.
4. Cancellation, Refunds & Expiry Date
1. You may cancel your purchase at any time prior to your payment. After your payment, no refunds are permitted for Otter Gift Card and you may not change the recipient.
2. (a) Otter Gift Card will expire when it is not redeemed by the recipient within one (1) year from the date of purchase (“Redemption Period”); and (b) Subject to Otter Gift Card having been redeemed during the Redemption Period, the balance in Otter Gift Card shall expire in one (1) year from the date of last redemption of any Otter Gift Card within the Redemption Period of the relevant and respective Otter Gift Card, if any.
3. Upon the expiry of Otter Gift Card, Otter Gift Card and its balance remaining will not be valid for any use and be automatically forfeited and cannot be refunded to you or the recipient.
Solely for illustration purposes:-
• the recipient receives 3 Otter Gift Cards on different dates;
• the recipient redeems the 3 Otter Gift Cards on different dates within the respective Otter Gift Cards’ Redemption Period;
• the expiry date for Gift Card A and Gift Card B will follow the latest redemption which is from the date of the recipient’s redemption of Gift Card C:-
5. Delivery
1. Upon your successful payment, Otter Gift Card shall be delivered to the recipient which the recipient may use upon redemption within the Redemption Period. Otter Coffee is not responsible for any lost or stolen Otter Gift Cards.
2. If you fail to enter an accurate email address or mobile number for the recipient, then Otter Coffee is not responsible for any undeliverable or erroneous delivery (i.e. sent to wrong person) of Otter Gift Card. Please contact the Customer Service Team if you suspect the recipient did not receive Otter Gift Card.
6. Reservation of Rights
1. Otter Barista reserves the rights not to accept any Otter Gift Card or otherwise limit the use of Otter Gift Card if Otter Barisya reasonably believe that Otter Gift Card or the use or the manner it was procured is unauthorized, fraudulent or otherwise unlawful.
2. The terms and conditions may be revised by Otter Barista from time to time where such revisions will be effective when they are posted on Otter Barista’s website.
7. Limitation of Liability
1. Subject always to applicable consumer protection laws and to the maximum extent permitted by law, Otter Barista will not be liable for claims or damages of any kind arising out of or in connection with your purchase of Otter Gift Card and the use of it by the recipient. This applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
8. Complains or Enquiries (Customer Service Team)
1. Otter Barista reserves the right to correct the recipient’s Gift Card amount and your payment if Otter Barista believes that a technical, clerical, billing or accounting error has occurred. If you have any questions regarding the transaction history or any correction, or if you dispute any transaction or correction that has been assessed against your Otter Gift Card, please contact our Customer Service Team by email at support@otterbarista.com and Otter Barista will conduct an investigation, communicate the results and correct any proven error as soon as Otter Barista complete the investigation.
